How we handle the data of those who write to us

Information notice under Articles 13 and 14 of EU Regulation 2016/679 (GDPR) and Italian Legislative Decree 196/2003, as amended by Legislative Decree 101/2018. This is a courtesy translation: in case of any discrepancy, the Italian version prevails.

Who processes the data

The data controller is Flawless Living S.r.l., with registered office at Via G. Rossini 4, 20122 Milan, VAT no. 08675550969, operating under the Westwood PR & Communication brand.

For any matter concerning personal data, you can write to info@westwood-pr.com. No data protection officer has been appointed, as none of the cases set out in Article 37 of the Regulation applies.

What data we collect

Contact form data. Name, email address and the text of the message. These are the only data we ask for, and we ask for them only from those who choose to write to us.

Newsletter subscription data. The email address alone. Together with the subscription we record the date, time, IP address, the page it started from and the exact wording of the consent accepted: these are not used to profile anyone, but to be able to show that consent was given, as required by the accountability principle in Article 5(2) of the Regulation.

Technical browsing data. Like any website, the server records the IP address, the date and time of the request, the page requested and the type of browser. These are automatic logs kept by the service provider; they serve the security and operation of the site and are not used to identify anyone.

The site does not use third-party analytics tools, does not profile its visitors and does not collect special categories of data.

Why we process them

Form data are used to read the request and reply, and to take any steps the request itself involves. The legal basis is the performance of pre-contractual measures taken at the request of the data subject, Article 6(1)(b) of the Regulation.

Technical browsing data are processed for the security and proper functioning of the site, on the basis of the controller’s legitimate interest, Article 6(1)(f).

The email address of newsletter subscribers is used only to send the newsletter. The legal basis is consent, Article 6(1)(a): it is given by ticking the box in the form, it is optional and it can be withdrawn at any time, without giving reasons and without affecting anything else.

Those who write to us through the contact form are not subscribed to the newsletter: these are two separate things, with two separate consents.

How long we keep them

Messages received through the form remain in the agency’s mailbox for as long as needed to reply and to manage any relationship that follows. If nothing follows from the request, they are deleted within twenty-four months.

The address of newsletter subscribers is kept until the subscription is withdrawn. Upon withdrawal the address is removed from the list; the record of the consent and of its withdrawal is kept for as long as needed to defend against a dispute, and in any case for no more than five years.

Server logs are kept for the period set by the hosting provider, usually a few months.

Who else sees them

The data are processed by authorised and instructed agency staff. They may also be accessed, as processors appointed under Article 28 of the Regulation, by the providers that make the service possible:

  • the web space and email provider;
  • the provider that actually delivers the newsletter emails;
  • consultants, when the request makes it necessary.

The data are not disclosed, are not sold and are not passed on to third parties for their own purposes. No transfer to countries outside the European Economic Area is planned. Should one become necessary in the future, it would take place only with the safeguards set out in Chapter V of the Regulation.

Cookies and third-party tools

This site does not use profiling, analytics or third-party cookies, which is why no banner appears: under the 2021 guidelines of the Italian Data Protection Authority, a banner is only needed when cookies other than technical ones are used.

The only cookie the site may set is a technical one: it remembers the language chosen with the IT · EN switch, contains no personal data and expires after one year.

To know how many people visit the site and which pages they read, we use Umami, an analytics program installed on our own server in Europe rather than on that of a third-party provider. Umami does not use cookies and does not store IP addresses: it records only, in aggregate form, the page opened, the referring site, the country, and the type of device and browser. These figures cannot be traced back to individual visitors and are used only to understand how to improve the site; the legal basis is our legitimate interest.

The typefaces and the libraries that animate the pages are hosted on our own web space and are not loaded from external servers. This means that, when the site is opened, the browser does not share the visitor’s IP address with any third-party provider.

The site does not embed videos, maps or social media widgets from other services. The links to Instagram and LinkedIn are simple links: data are processed by those platforms only if you choose to follow them, in which case their own privacy notices apply.

Your rights

Articles 15 to 22 of the Regulation give you the right to request access to your data, to have them rectified or erased, to restrict their processing, to data portability, and the right to object to processing based on legitimate interest.

Newsletter recipients can withdraw consent at any time, with one click on the unsubscribe link at the bottom of every mailing, or by writing to us. Withdrawal does not affect the lawfulness of what was done before.

To exercise the other rights, simply write to info@westwood-pr.com. You will receive a reply without undue delay and in any case within one month.

You also have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali), Piazza Venezia 11, 00187 Rome, garanteprivacy.it.

If anything changes

This notice may be updated when the site or the way data are processed changes. The valid version is always the one published here, with the date at the bottom.
